Alleged drug trafficker on suspended jail term drove to court-ordered appointment without a licence

An alleged drug trafficker on a conditionally suspended jail term was caught driving to a court-ordered Community Corrections appointment despite having his licence disqualified. Kyle Seath Fogliani, 28, appeared in Bunbury Magistrates Court on Thursday, where he admitted to driving without a licence on April 11 while on a conditionally suspended prison order and facing a charge of allegedly being found with a trafficable amount of methylamphetamine with intent to sell or supply on October 11 last year. He is yet to enter a plea on the drug matter, but his lawyer told the magistrate Fogliani wanted to deal with the driving matter, even though it would breach his order and push back the plea hearing. The court was told the man had an appointment with Community Corrections on April 11 and had “no other option” to get there after the lift he had organised fell through. Prosecuting officer Sgt Tim Concannon told the court Fogliani was found riding a motorcycle near Donnybrook. Magistrate Anthony Sullivan said it would be “unjust” to charge Fogliani with a breach of the order after the court was told he was otherwise complying. Mr Sullivan adjourned the drug trafficking hearing until December 19, extended Fogliani’s bail and ordered the conditional suspended imprisonment order continue. Fogliani was fined $1000 and was ordered to pay $272.70 in court costs.
