Bunbury man twice raped vulnerable South West teenager without regard, says District Court judge

A Bunbury man who twice raped a vulnerable South West teenager while high on meth did not care to find out how old she was or whether she was interested, and was prepared to “act as muscle”, a District Court judge has said. In November 2021, the girl was living with friends of the 39-year-old offender, who cannot be named. It’s claimed they were also allegedly abusing her, both sexually and by injecting her with drugs, keeping her awake and vulnerable. It was during this time Judge Wendy Gillan said the man — who used methylamphetamine — had no regard for the girl’s mental or physical safety as he raped her twice on a couch, alone, in the backyard. The man was sentenced in the Perth District Court on August 13 after being found guilty following a trial on two counts of aggravated rape in November 2021. Judge Gillan said on the first occasion, there were no signs of mutual attraction, but the man “decided” to “simply help” himself to the girl, who had “no way of saying no and did not physically resist”. On the second occasion, the offender told the girl “let’s have some fun”, to which she responded “no”. “Without regard to her answer”, Judge Gillan said, the man then raped her again. The court was told the girl told the adult woman also living in the home, but was not prepared to make a formal complaint. She later reported the incidents to someone living outside the home and the matter was brought to the police. “She was scared. She was disgusted in you. She was shocked, and she felt unsafe,” Judge Gillan said. “She’s also felt disgusted in herself for not doing more to stop you. She has felt ashamed.” Judge Gillan said the man had a troubled past with his own trauma, as well as two children he had limited contact with because of his drug abuse. “On your own admission, you were prepared to act as muscle and you weren’t afraid to use your physicality, and that’s no doubt the reason that she was afraid,” she said. “On both occasions, you simply helped yourself to a young and vulnerable person, ignoring her saying no on count two. “You simply took advantage of a young girl that you were not interested in finding out how old she (was), or really interested in finding out whether she was particularly interested in you and consented to what was going on. “I understand one of your children is a girl, and I think . . . that you wouldn’t like to see your own daughter in the position that (the victim) was in.” Judge Gilllan said she could not find the man knew the details of the other abuse the girl is said to have been subjected to, but it was “very likely” he knew she was being given drugs and was vulnerable. He was sentenced to eight years in jail for two counts of aggravated sexual penetration without consent, and the court was told this would run concurrently with another jail term he was already serving. He was made eligible for parole, and Judge Gillan encouraged him to take up counselling to address the reasons behind his drug and alcohol abuse, which she said evidently led to “opportunistic offending”.
