Ricky Hirsch: Fugitive scammer faces day in court and says he’ll return to Perth eventually

Fugitive conman Ricky Hirsch has told a court he would return home to Perth in the future — but didn’t say when. His presence would be needed if he wanted to defend himself in a civil trial, barrister Conor Breheny told the WA District Court on Thursday. Mr Breheny was representing a Melbourne-based company, Private Lender, which is seeking a summary judgment against Mr Hirsch for failing to repay a $400,000 loan made in in 2022. The Sunday Times has exposed the plight of Mr Hirsch’s scores of victims, who invested in his Fulfil The Dream “property empire” and got nothing in return. Many lost their life savings. Mr Breheny said if the case went to trial instead, Mr Hirsch would need to be present in person. He also applied for the court to require Mr Hirsch put up at least $400,000 as security if Registrar Greg Nairn decided a trial was needed. Mr Hirsch, who appeared by video link from Bali, said he didn’t have that amount of money. “It’s not that easy to come up with 400K,” he said. “I daresay, if there is any money owing . . . at the end of this . . . it would (have to) be in a payment plan or something of that nature.” Mr Hirsch’s now-defunct property development company borrowed the $400,000 in November 2022, with Mr Hirsch as its guarantor. The court was told the loan was meant to have been repaid in six months, but wasn’t. Only four small interest payments of $5000 in August 2023 were made. Mr Hirsch accused Private Lender of reneging on a refinancing agreement around that time, which he said had devastating repercussions for his company. He said he’d been “led down the garden path” and described Private Lender’s actions as “unconscionable” and “predatory”. Mr Breheny said Mr Hirsch’s assertions weren’t backed up by any evidence. “It’s pure conjecture,” he argued. Mr Hirsch said he didn’t believe he should have to repay all the money because of the lender’s alleged conduct. “I lost everything . . . is it not possible lenders also lose (everything)?” He said. “Is that $400,000 still applicable when I have no assets left, that I believe partly was (the plaintiff’s) fault?” Mr Nairn said he saw nothing in Mr Hirsch’s affidavit which explained how the lender caused him or his company a loss. Mr Breheny said allowing the matter to drag on was unfair on his client. Registrar Nairn said it was a “bit of a head scratcher” that Mr Hirsch gave his address as (his former property) at West Coast Drive, Marmion. “If it is your address, why it is that you’re appearing by audio visual link from overseas?” Mr Hirsch said he’d been overseas for 18 months. “I am overseas doing what I can for the work that I have been given (there), but do I believe I’ll come back — of course,” he said. Mr Nairn asked: “You’re not currently in the West Coast Drive address?” Mr Hirsch replied: “I’m not physically staying there right this moment. It’s kind of like saying, ‘if I’m in Australia, where do you send my post?’ Mr Breheny pointed out the Marmion property had been (repossessed by lenders) and sold. “Certainly, it’s my expectation, Mr Hirsch, that if an affidavit was filed that it reflect your true and correct address at the time (it) is sworn,” Mr Nairn said. The registrar gave the parties seven days to file final submissions and said he would make a decision soon thereafter.
